2009-25: New Reaffirmation Agreement Cover Sheet and Reaffirmation Agreement Documents

Although Rule 4008, Filing of Reaffirmation Agreement; Statement in Support of Reaffirmation Agreement, is amended effective December 1 to require use of a cover sheet, prepared as prescribed by the appropriate Official Form, the judges have determined that filers will have a two-month grace period to update their forms.  The cover sheet will be required to be filed with the reaffirmation agreement as of February 1, 2010.

A reaffirmation agreement filed on or after February 1, 2010, will not be approved unless the required cover sheet is filed with it.

The Reaffirmation Agreement Cover Sheet, Official Form B27 is posted on the Forms pages of the Court’s website in pdf, WordPerfect and MS Word formats.  Search for Official Form 27.

Even though the judges are allowing this two-month grace period, the Clerk’s Office will be sending notices of error in cases where reaffirmation agreements are filed without the cover sheet.  

New Reaffirmation Agreement Documents

Procedural Forms B240A, B240B, and B240C are posted on the Forms pages of the Court’s website in pdf format only--for the time being.  The judges will be taking a look at these documents more closely before requiring their use.  Until further notice from the Clerk’s Office, filers may use either the new reaffirmation agreement documents or the current form revised August 10, 2009, for use in this District.
