2009-26: Reaffirmation Agreements and the Cover Sheet

Until February 1, 2010, the judges will not actively enforce the requirement of amended Rule 4008 to file the new Reaffirmation Agreement Cover Sheet, form OF B27, with a reaffirmation agreement. The Clerk’s Office, however, will enter a notice of error to bring this omission to the filer’s attention.

Beginning February 1, 2010, the judges may not approve or may even deny without a hearing a reaffirmation agreement filed without the cover sheet.

Please also note that reaffirmation agreements that do not literally reproduce the wording required by 11 U.S.C. section 524(k) will be particularly scrutinized.
