Temporary Exclusion

When a debtor is a reservist or member of the National Guard and invokes the exclusion period by completing the Statement of Exemption from Presumption of Abuse Under § 707(b)(2) Form 22A-1Supp, follow the instructions below:

• In a non-joint case, select "No Presumption of abuse"
• In a joint case where one or both debtor's claim the exclusion period, each debtor must submit a separate Form 22A-1
• • If only one debtor claims the exclusion, make the presumption of abuse selection based on the debtor who is not claiming the exclusion
  • If both debtors claim the exclusion, select "No presumption of abuse"

• If electing the Military Exclusion, you are required to file Form 22A-1Supp separately from the petition  using the event Chapter 7 Statement of Monthly Income 22A-1 / Exemption Presumption of Abuse 22A-1Supp
