File a Proof of Claim

A Proof of Claim is a written statement and any verifying documentation that is filed by the creditor.  The claim describes the reason the debtor owes the creditor money.  Use the Official Form below to file your claim with the court.

File a Proof of Claim On-line

You may file a proof of claim electronically, via the Internet.  To do this, you will need a limited-use e-filing (ECF) account with the Bankruptcy Court, District of New Mexico.  To register for an ECF limited-use account and for instructions for accessing the Court's electronic filing system, go to CM/ECF - Registration and Training page.  There is no fee to register for an ECF account or to file a Proof of claim; however, you do still need to use the official Proof of claim form and attach it as a PDF during the on-line filing process.  Instructions for filing the Proof of claim on-line can be found here in PDF format.  Or, if you prefer, step-by-step instructions can be found by searching "proof of claim" using the on-line Electronic Filing Manual.

File a Proof of Claim in Paper

You may file a proof of claim in paper.  Complete the Proof of Claim and mail the completed form along with an extra copy and a self-addressed, stamped envelope, to the Clerk's Office.   When you submit an extra copy and a self-addressed, stamped envelope, the Clerk's Office will return a "filed" copy to you for your records.  If you choose to deliver the proof of claim to the Clerk's Office in person, please bring an extra copy with you.

NOTE:  IF YOU  FILE A PROOF OF CLAIM , YOU DO NOT NEED TO FILE A SEPARATE CHANGE OF ADDRESS OR REQUEST FOR NOTICE.   THE CLERK'S OFFICE WILL CHANGE YOUR ADDRESS IN THE CASE TO MATCH THE ADDRESS ON THE PROOF OF CLAIM.
