Default Orders

Default orders should contain the following information:

  • The date the motion was filed.
  • The date that notice of the motion was given.
  • A statement of to whom the notice was given.
  • The deadline for filing an objection (be sure to include three days for mailing pursuant to Bankruptcy Rule 9006(f)).
  • A statement that no response has been filed.
  • A statement of compliance with the Soldiers and Sailors Relief Act of 1940 as amended.

Default orders should only grant the relief actually requested in the motion on file with the court. For example, if a motion for stay relief has not asked for relief from the stay provided by Bankruptcy Rule 4001(a)(3), the order should not provide that relief.
